1. Introduction
These Terms and Conditions govern access to and use of My Renovation Guide, including all websites, landing pages, forms, communications, contractor matching services, quote comparison services, appointment scheduling services, and related offerings operated by Luckystar Media Ltd. By using the Services, users agree to be bound by these Terms.
2. Eligibility
Users represent that they are at least eighteen (18) years of age, are located within the United States when submitting service requests, and possess legal capacity to enter binding agreements.
3. Description of Services
My Renovation Guide operates as a lead generation, homeowner qualification, contractor matching, quote comparison, and appointment facilitation platform. The Company does not itself provide roofing, windows, bath remodeling, HVAC, pest control, gutter, or other home improvement services.
4. Contractor Matching and Appointments
Consumers acknowledge that requests may be reviewed, qualified, and assigned to independent contractor partners. The Company may contact consumers directly to verify project details and schedule appointments with a contractor partner.
5. Communications Consent
By submitting information, users expressly request contact regarding their inquiry and consent to communications by phone, email, SMS, voicemail, artificial voice technology, prerecorded messages, and dialer-assisted technologies where permitted by applicable law.
6. TCPA Disclosure
Consent is not a condition of purchase. Message and data rates may apply. Consumers may revoke consent where required by law. The Company may maintain records of consent including timestamps, IP addresses, call recordings, TrustedForm certificates, and Jornaya LeadIDs.
7. Electronic Records and Signatures
Users agree that electronic disclosures, agreements, records, and communications satisfy any legal requirement that communications be in writing.
8. User Representations
Users agree to provide truthful, accurate, complete, and current information. Submission of false, misleading, or fraudulent information may result in termination of access to the Services.
9. Contractor Disclaimer
The Company may perform limited screening of contractors but does not guarantee contractor licensing, insurance, qualifications, pricing, workmanship, performance, project outcomes, availability, or responsiveness.
10. No Guarantee of Quotes or Pricing
The Company does not guarantee consumers will receive quotes, estimates, appointments, or contractor responses. Pricing is determined solely by independent contractors.
11. Privacy and Data Practices
Use of the Services is subject to the Privacy Policy. Users acknowledge that information may be processed for contractor matching, appointment scheduling, analytics, fraud prevention, and compliance purposes.
12. Intellectual Property
All trademarks, logos, branding, software, website content, designs, graphics, text, and other materials are owned by the Company or its licensors and may not be used without authorization.
13. Prohibited Conduct
Users may not interfere with website operations, attempt unauthorized access, scrape data, submit automated requests, impersonate others, or use the Services for unlawful purposes.
14. Disclaimer of Warranties
The Services are provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, the Company disclaims all warranties, express or implied.
15. Limitation of Liability
To the maximum extent permitted by law, the Company shall not be liable for indirect, incidental, consequential, punitive, special, or exemplary damages arising from use of the Services.
16. Indemnification
Users agree to defend, indemnify, and hold harmless the Company, its affiliates, officers, directors, employees, contractors, and service providers from claims arising from misuse of the Services or violation of these Terms.
17. Dispute Resolution
Parties agree to attempt informal resolution before initiating legal proceedings.
18. Binding Arbitration
Subject to applicable law, disputes arising from these Terms shall be resolved through binding arbitration rather than litigation in court.
19. Class Action Waiver
Users agree that disputes will be brought only in an individual capacity and not as part of any class action, representative action, or consolidated proceeding.
20. Governing Law
These Terms shall be governed by the laws of the State of Florida without regard to conflict-of-law principles.
21. Force Majeure
The Company shall not be responsible for delays or failures caused by events beyond its reasonable control.
22. Assignment
The Company may assign these Terms and its rights and obligations without restriction.
23. Severability
If any provision is found unenforceable, remaining provisions shall remain in effect.
24. Entire Agreement
These Terms, together with the Privacy Policy and incorporated disclosures, constitute the entire agreement between the parties.
